1. Scope of Service

NewBuildLeads provides project intelligence, municipal permit data, and industry contact information (the "Service"). Our Service is designed to provide insights into project timelines and construction activity to assist subscribers in their business development and prospecting efforts.

2. No Guarantee of Outcomes

While NewBuildLeads strives for high data accuracy, all information is provided "as-is." * Data Nature: We aggregate data from municipal filings and public records, which are subject to change or error at the source. We do not guarantee the accuracy of project start dates, valuations, or contact details.

  • Prospecting Success: NewBuildLeads is a tool for intelligence. We do not guarantee that the use of our data will result in successful prospecting, meetings, or the awarding of contracts.

3. Use of Contact Information & Compliance

The Service may include contact information for contractors, developers, or project stakeholders.

  • Authorized Use: This information is provided solely for the subscriber's direct, internal business development efforts.

  • Legal Compliance: Subscribers are solely responsible for complying with all applicable anti-spam and privacy laws (including but not limited to CASL and CAN-SPAM) when using contact information provided by the Service.

4. Intellectual Property & Use Restrictions

All reports and data provided are the exclusive property of NewBuildLeads.

  • Internal Use Only: Your subscription grants a license for internal use by your business entity only.

  • Restrictions: You may not redistribute, resell, or publicly display any data or contact lists provided by NewBuildLeads. Unauthorized sharing of data or login credentials will result in immediate account termination without refund.

5. Refund Policy

Due to the digital nature of our project intelligence, all sales are final. NewBuildLeads does not offer refunds once data has been accessed or reports have been delivered.

6. Indemnification

You agree to indemnify, defend, and hold harmless NewBuildLeads and its owners from any claims, liabilities, damages, or costs (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights (including privacy or anti-spam laws).

7. Limitation of Liability

In no event shall NewBuildLeads be liable for any incidental or consequential damages, including loss of profit or business opportunities, arising from the use of our information. Our total liability to you for any claim shall not exceed the amount paid by you for the Service during the one (1) month prior to the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.
